RESIDENT MAGISTRATE’S COURT.
Tins Day. (Before I, N, Watt, Esq., E.M.) Paterson and M'Leod y. A. Wppd.—L6 Os 2d. Claim for goods supplied. Defendant admitt d liability, but said he was unable to mee-t it, owing to ill-health. Judgment for plaintiffs with costs. Montague v. Huffman.—Claim of T 2 19s, balance of account for board and lodging. Mr Harris for plaintiff ; Mr Stout for defendant. Hr Harris stated the case that plaintiff and defendant were, in the month of October, 1860, jointly engaged in a contract for some three or for four weeks, during which time the defendant boarded and lodged with plaintiff. The had been no agreement as to tho charge, but he had put down what was fair and reasonable.—Plaintiff said he had been paid 15s of the account. In crosss-examination plaintiff admitted he had sued defendent in Cromwell, but did not then put in a claim for taking a dead child in a cab to the cemetery belonging to defendant. He also paid back 10s to Mr Hoffman which he had borrowed. For the defence, it was urged that the Court had no jurisdiction on two amounts, as they were partnership accounts, and that the remainder had been arranged in a final settlement. The case was dismissed with costs, as the evidence showed the subs had been individual and not partnership suits, and that there appeared to have been a settlement some eighteen months ago.
