RESIDENT MAGISTRATE’S COURT.
This Day. {Before A. C. Strode, Esq., R.M.) Civil Cases. Bacon and Sons v. William Black.— L 44 4s, for hire of horse and buggy, a whip, a buggy rug, a saddle, also freight on same from Lyttelton. Mr Harris for plaintiff. The hire of the buggy was charged at the rate of 12s 6d a day for fifty-three days. Judgment for plaintiff for the amount, with costs.
Newman v. Freeman.—L3 11s 6d, balance of account for meat supplied. Judgment by default for plaintiff for the amount, with costs.
Pollock v. Rayburn.—Lls, Mr Howorth for the plaintiff; Mr Stout for the defendant. This was an action brought by Pollock, as trustee in ihe estate of Scott, a bankrupt, for the value of a horse put out to graze at 2s fid a week, which had wandered out of, or been taken out of, defendant’s paddock. For the defence, Mr Stout claimed a nonsuit, on the grounds that there was no evidence of the appointment of Pollock as trustee, and that defendant never took the horse to graze as an agister of cattle.—On the merits of the case the defendant stated that Scott, about the time of his bankruptcy, went and told him he had a lame horse which he could not afford to keep, and that he agreed to take him, and allow him to graze in his paddock free of charge. He told Scott that he would not be responsible for the horse. His fences were in good order, and on missing the horse he went round the paddock, and found the fences good and the slip panel up. He gave information to Scott that the horse was missing tbe following day. Scott offered to sell him the horse for L 4, but he declined to have any buying or selling, as it was Sunday. Scott’s statement that he was to pay 2s fid a week agistment was a gross and ungenerous falsehood. Judgment was about to be given for the defendant when Mr Howorth applied for a nonsuit, which the plaintiff refused to accept, and judgment was givezi for the defendant. Eowntree v. Flynn.—L4 18s, for .vork done. The defendant admitted owing L2 13s. Judgment for plaintiff for the amount claimed, with costs.
