RESIDENT MAGISTRATE’S COURT.
This Day. (Before A. 0. Strode, Escj,, R.M.) Civil Casks. Faulkner v. Has tie, —L4 10a. Mr F. J. Wilson appeared for defendant. No appearance of plaintiff. Case dismissed with c sts. Fincher v. Connue. —LI3 Ss 9d, for groceries supplied. Judgment by default for the plaintiff for the amount with costs. Lund v. Miller and Orr. Mr Cook for plaintiff. This was an application to obtain possession of certain premises held by the defendants, claimed by the plaintiff. His Worship said a warrant would bo issued authorising the Bailiff of the Court to deliver up possession.
The City Corporation v. Millar.—L4 8s 6d. In defence the defendant denied liability, having no beneficial interest in the property. This was a claim for rates on six cottages on section 23, block 14. F. H, Evans said that he collected the rates as authorised, by Air
Millar, under a power of attorney, and paid, the rents to him. The defendant produced receipts to shew that he only acted as agent of Edwin Millar, who was the proprietor of the property, and that he said that the 1 power of attorney had been returned to him. His Worship did not consider that he could fix the liability to pay upon the defendant, as the Act did not provide for per.-o us situated in regard to the property as he was. The Corporation by their own act in the notices served upon him, acknowledged him only to bo agent: the evidence of Mr Evans confirmed this, and the receipts shewed he had no beneficial interest. Judgment for the defendant. Alexander and anotliorv. Melbourne.— L2, for butcher’s urn at. Judgment by default for the plaintiff for the amount with costs.
