RESIDENT MAGISTRATE’S COURT.
This Day. (Before I. N. Watt, Esq., E.M.) Civil Casks. IT. S. Fish, jun., v. Hyatt.—L9 17s 4d, for go-'ds supplied. Mr Stewart for the defendant. This was an action to recover the amount of an account for goods ordered by one Cri s-i, a commission agent, alleged to be on behalf of the defendant. The defendant resides at Waikouniti. For the defence, Mr Stewart contended that there was no proof that Hyatt had given authority to Cross to purchase goods on his behalf; and further, that the cause of action being in Waikonaiti, the case should have been tried in the Magistrate’s Court there.-—His Worship did not consider the proof of agency satisfactory, and the plaintiff was nonsuited. |
A. M'Kay v. M'Kay.—L2o. For the defence a set-off of L 22 was put in. The litigants are brothers, and had had a number of cross transactions involving very complicated accounts. Judgment for the plaintiff, L 9 19a, and costs.
