The facts of the case art shortly theseOn the evening of the 22nd the parties were in the shop of Mr Josephs, tobacconist, Rattray street, discussing business matters. In the course of the discussion, which at times appears to have been unnecessarily animated, the defendant remarked that he always paid 20s in the £ ; whereup n the complainant, who fancied that the remark was intended as an insinuation against him-e f, retorted by saying that that was more than the defendant’s brother could siiy. Thereupon the defendant knocked the complainant’s hat off, and struck him in the eye. His Worship considered that the assault, though slight, was unjustifiable, and that the provocation was first given by the defendant. The plaintiff’s remark did not justify the defendant striking him. This kind of thing was too prevalent in Dunedin. People thought themselves justified, because a few words were spoken, m at ouce raising their fists and striking a person —a sort of thing that could not be allowed. The defendant would be fined 40s and costs, together with a guinea professional costs. OFFENCES AGAINST THE BYE-LAWS, Ellen Green and Marion Waddell were fined 2s 6d each for using the company’s water without paying rates. A charge of a similar nature prefened rgainst Nancy Lewis and William Wynn, and charges of allowing the water to be improperly used, preferred against John Collie and George Johnston, were dismissed with a caution. Clarence Borthwick was fined Is for riding across the footpath in Melville street, and George M‘Gavin Is and costs for neglecting to keep his premises elean.
