Civil Cases.
Marshall v. Ford.—Lloo, for damages sustained by alleged setting tire to plaintiff’s fences, crops, and timber. Mr Edward Cook for the plaintiff ; Mr Stout for the defendant. According to the evidence of the claimant, the defendant set fire to the Lush on his land on the 23rd D-. cember, which spread to the claimant’s land, destroying abont three acres of bush, besides from 70 to 100 standing timber trees, 100 rails, 70 posts, above 100 cords of firewood, a small field of oats and one of hay, as well as about three chains of a dividing fence. The plaintiff estimated his loss at L 173 10s. Afire was kindled on the 6th December on part of his own ground, which began to spread too rapidly, and was extinguished totally the folowing day. The examination of the plaintiff occupied about three hours, and abont thirty witnesses were subpeenaed. The sum of his examination is contained in the few lines we have given.
