RESIDENT MAGISTRATE’S COURT.

This Day. (Before A. C. Strode, Esq., R.M.) Civil Case. Every v. M‘Donald,—The respondent was required to show cause why he had not paid the amount of a debt for which judgment had been obtained against him in the Court. He was ordered to pay the amount, L2 6s 6d, within two months, or be imprisoned. Laing v. Towers and others, executors in the estate of the late Mr Towers.—Lso. This case has been already before the Court, when judgment was given for the defendant through non-production of the assignment of lease from the original tenant, J. R. Hood, to the late Mr Towers. Mr Harris for the plaintiff; Mr Stout for the dlifeudant. The evidence was taken of A. Findlator and Mr Mackenzie, registrar of deeds in the Supreme Court, to prove certain documents The short facts are that the plaintiff leased certain property to J. R. Hood, that the lease was by him transferred to the late Mr Towers. The rent was regularly paid on behalf of the executors by Mr C. Reid until that due in November. Since that, on Mr , Reid being applied to, he declined further payment through want of funds. Mrs Towers was called, who said she never had in her possession nor saw a deed of transfer of a lease from Hood to Towers. After much evidence Mr Finch was called, "who was trustee in Hood’s estate. He said that the interest of the trustees was sold to Mr Towers, and a deed of transfer was executed in his favor. (The case was adjourned for the evidence of an important witness.)
