This Day. (Before J. Fulton, Esq., R.M.) Civil Cases. Strachan v Sturrich.—Lß 4s. Mr Howorth for the plaintiff. Judgment by default for the plaintiff, with costs. D. M'Master v. Ralston.—'*r Howorth for the defendant. The plaintiff did not .appear, and the case was dismissed—plaintiff to pay professional costs. Miller and Hall v. Falconer.—L6 ss, a claim for board. The defendant admitted owing for a month’s board. A witness named Johnston, who had kept the books, said he know the amount to be correct. Judgment for the plaintiff for the amount, with Posts. Hilton v. Teller.—L2 10s, balance of account. Mr Harris for the defendant. In

regard to a set-off amounting to L 3 7s 6d, the plaintiff put in a discharge in bank* ruptcy. In answer to Mr Harris, the plaintiff said he tiled a list of all the names of his creditors excepting that of the defendant. He paid no dividend. The defendant admit* sed the amount of the account, L2 10s, to be correct. The plaintiff was indebted for rent and for half subscription to the Daily Times newspaper to the amount of the set off claimed. Mr Harris held that not having complied with the requirements of the Bankruptcy Act, the plaintiff was not entitled to take the benefit of his discharge in bankruptcy, and that the subscription to the newspaper had gone on for a long time subsequently to its date. Judgment for the defendant. ' oung v. Chapman.—This was a charge by the complainant, who is a seaman, that the defendant wrongfully detained two boxes containing wearing apparel, value HO. The defendant said he had a lien upon the goods, as the claimant owed him money for board, he defendant said he was no longer proprietor of the York Hotel, but had the boxes at his private residence. Judgment deferred.
