Tti/s Day, (Before A. C. Strode, Esq., R.M.) Civil Gases. Bradshaw (Provincial Treasurer) v. Mercer.—L4 ss, for balance of passage money from Scotland, and interest. Mr Stewart for the plaintiff. As there was an error in computing the interest, the plaint note was allowed to be amended, and L 5 4s was substituted for the original laim. Judgment by default for the plaintiff for the amount, with costs. Croshaw v. Fleming.—L3 10s.—Mr Hodgkins for the defendant. This was a claim for money alleged to have been borrowed. There bad been some transactions between the parties in relation to the release, and sale of a chain from a,pawnbroker, and the plaintiff said money had been borrowed for that purppse, as well as at other times , The defendant denied having borrowed money at anytime. In cross-examination the defendant said the chain was not pawned by him. and he bought it of the owner. 1 Being statement against s atement, without balance of evidence on cither side, judgment was given for the defendant; costs refused. Johnstone v. Bust.—L‘s 12s 3d, for work, and labor done. Judginent for the plaintiff for the amount, with costs. Melicamp v. Paterson. —L 3 3s, for rent of a tenement. Judgment by default, L2 13s, for the plaintiff 1 , 1 10s having been paid 'since tho : service Of the summons. i Baxter v. Mi: jer.—l/6 Ha fid, balance of account for groceries, Judgment by default for the plaintiff for the amount claimed, with costs. Sampson v. Shackleford.—LG 19s- Gd, lor goods supplied. The defendant'pleaded the account was “not yet due.” The plaintiff said the defendant, a perfect stranger, ordered the goods, and. he,expected the pay? ment would he made/on thje follow ing Monday. The defendant said the agreement was that the goods should be paid for in a month. . Judgment for the plaintiff for thd amount, with costs. 1
