As there was an error in computing the interest, the plaint note was allowed to be amended, and L 5 4s was substituted for the original laim. There bad been some transactions between the parties in relation to the release, and sale of a chain from a,pawnbroker, and the plaintiff said money had been borrowed for that purppse, as well as at other times , The defendant denied having borrowed money at anytime. In cross-examination the defendant said the chain was not pawned by him. and he bought it of the owner. 1 Being statement against s atement, without balance of evidence on cither side, judgment was given for the defendant; costs refused. The defendant'pleaded the account was “not yet due.” The plaintiff said the defendant, a perfect stranger, ordered the goods, and. he,expected the pay? ment would he made/on thje follow ing Monday. The defendant said the agreement was that the goods should be paid for in a month. . Judgment for the plaintiff for thd amount, with costs. 1
