RESIDENT MAGISTRATE’S COURT.
Tuts Day. (Before I. N. Watt, Escp, 11. M.) Givir, Casks. Mills, Dick, and Go. v. Hoskins.—Ls 19s Bd, was adjourned to Monday next. Simpson and Asher v. Green.—L7. Mr Calomore for the defendant, pleaded not indebted. For the defence, it was alleged that the sum claimed was for meat supplied to Mr Drummond, the defendant’s predecessor inthe hotel occupied by him. The plaiatilF in'rcply, stated that the defendant agreed to pay Drummond’s account, and had paid L 5 on account of LI 18s 4d, due by him. A. Muir stated that ho heard the defendant agree to pay the account due by Drummond. Mr Catomorc held that the law required any promise by one party to pay money due by another to bo in wri.ing, and therefore any verbal promise was void, and that the account due by Green was overpaid. In evidence the defendant said the agreement, to which Simpson was a consenting party, was that as he received Drummond’s accounts to the amount due to Simpson and Asher, was to be paid. He did receive L 5 due to Drummond and paid it to plaintills. Judoment for the defendant.
One ease was struck for non-appearance of the parties.
