The result of the polling which appeared in last evening’s issue will ho found in one particular to he incorrect. It is due to Mr Bamfoul that we acknowledge the error. KAWARAU. The following are the final returns : Hickey 81 Hughes 82 Marsh ;, 'i The poll is to bo declared officially on Friday.

CHARGE OF LIBEL. Regina v. Barton.—For the prosecution, Mr J. M. Larnaeh, examined : I was a diicctor of the Dnihj Times and IVUness Company, Limited, on September last. In August I was on a visit in Melbourne, and returned to New Zealand by the Gothenburg, in September. 1 ieft, i think, on the 24th September, and arrived at the Bluff on the 2!) th, and in Dunedin on the Ist October last. The English mail was telegraphed at Melbourne just as we were putting off from the wharf. The departure of the steamer was d- layi d two or three hoars in consequence. Ony one edition of ihe .Argus extra, I think, was on hoard. I think there was another, but I did not see itonbnrl. It would he the second extra of the Argus. There was some further news put on hoard at Queenseliff before going through the beads Mr Micassey objected to the statement of the contents.
Examination resumed : A despatch in an envelope was put on board, addressed Otago Daily Times. I believe it was’delivered to the captain o • purser, ajid I bad it in my hand.*. The first time I saw it was on the evening of the 29th, just before our arrival at the Bluff. It was open. Tlief captain handed it to mo, and he read the contents in my {presence, and in that of Mr Martin, a brewer, of Invercargill ' I believe both Mr Martin and the captain read it. Ido not know that anyone read it aloud, for it was very short. The contents were never mentioned afterw.-rds on board in my hearing. In justice to the captain I ought to state that, on behalf of the Daily Times, I authorised him to open the envelope and road the telegram. The captain'put it away, and I never saw it after. It was 10 o’clock next morning before he sent it away, although he arrived at 8 o’clock in the evening. Directly I did not exact any promise of secresy in regard to the contents. (Left sitting.)
