This Day. (Before A. C. Strode, Esq., R.M.) Civil Cases. Ziele v. Mueller—L2o, balance of account for wines and spirits supplied. Judgment by default for the plaintiff with costs. Driver, Maclean, and Co. v. Burgess.— Lll 19s 6d, for advertising, commission and interest on sale of hotel, stock and furniture, and partnership effects of Burgess and Kruse. The sale was withdrawn in the first instance, Kruse being purchaser from Burgess, aud subsequently Burgess bought of Kruse. For the defendant, Mr Howorth contended that Kousc was liable according to agreement with Mr Maclean j that no sale having been made, the plaintiffs had no claim, and that in all probability Kruse had paid the expenses to his legal adviser. In his evidence the defendant said it was agreed that Kruse should pay Driver and Co. s expenses. His Worship considered the person who gave the instructions was personally liable, and that both parties should have been joined in the plaint. Judgment for the defendant. Orbell v. Roddam.—L9 Ms, for commission on skins sold to Messrs Cargill and Langseignc. Mr Howorth for the plaintiff. For the defence it was pleaded that no authority was given to plaintiff to sell. Judgment for the plaintiff for the amount with costs.
