Tins Day. (Before Ilia Worship the Mayor.) INDECENT EXPOSCUE. James Trembath, for indecent exposure of his person, was sentenced to three months’ imprisonment, with hard labor. ASSAULT. Thomas Kirk, on remand, was charged with assaulting Robert Gibson, at Mosgiel, on the sth of this month. Sergt. Thompson conducted the prosecution, and Mr M'Keay app ared for the defence. There were a great number of witnesses examined. The short facts were that a quarrel took place bet tveen the two men. and that Gibson being in a blacksmith’s shop and seeing Kirk passing, called out that he intended sending for the police in consequence of what had taken place. Kirk returned, and after a few words gave Gibson a blow, who threw an axe at him, but missed him. In return Kirk took up a piece of wood, weighing seven or eight pounds, threw it at Gibson, and bit him on the nose so heavily that he fell insensible, and left him. Mr M'Keay pleaded that the prosecutor was to blame for calling the prisoner back ; but his Worship considered the provocation no justification, and fii ei the prisoner L 5 and costs. A PLEDGED BREACH OF THE BYE-LAWS. A charge against James Cunningham, for allowing a cow to wander, was dismissed.
