David MTntyre, for driving a dray without a light, was fined 5s and costs ; and a similar penalty was imposed on Robert Paterson, for allowing the chimney of his house to take fire ; and on Robert Quin, for allowing a horse to be at large. ILLTREATING A HORSE. Alex. Thomson, a carrier, was charged with this goffence. Mr Smith defended. According to the evidence of Mr James Copeland and three other witnesses, on the 7th inst., the defendant was in charge of an eight horse team. On their passing the team in a cab they noticed that one of the horses was bleeding profusely from the nostrils and month, as Mr Copeland thought, from a previous beating. When they had gone on about 100 yards they noticed defendant beat the animal very brutally with a stick. For the defence witnesses were called who stated that the horse was an unbroken colt, and had been purchased by the defendant that day. On attempting to put it in harness it <f played up,” knocking defendant down, and injuring itself greatly about the head and legs, blood being drawn from both parts. When the team reached George street, where it was met by the witnesses for the prosecution, the horse again “ played up,” breaking the spread bar, with which the defendant in his excitement struck it, but did not |fio so in such a way as could be called cruel treatment. The Bench considered the charge proved, and fined the defendant 20s and cotsts.
