This Avas a dispute arising from the defendant imagining he had a right to impound cattle belonging to the plaintiff, which had trespassed on his property through plaintiff' not completing a dividing fence. The Magistrate explained that defendant would have had a Avell founded claim for damages for trespass, but he had no right to impound, as the fence Avas incomplete. Peterson v. A. Macpherson—L6 19s 4d. A claim for money lent and for loilging. Judgment for the plaintiff by default. Evans v. Dick—The defendant applied for a re-hearing on the ground of having boon misled by the hospital clock, and that in consequence he reached the Court after judgment Avas given. The request Avas acceded to, and the case Avas ordered to he heard again on Friday. Parker A r . .1. Campbell—A claim for L 3 4s 3d. Mr C'atomore for the plaintiff. The defendant pleaded a sot off. From the evidence it appeared that the defendant had acted as agent for the plaintiff, and the goods AA'Cx'e taken by him to sell on account of the plaintiff. The goods Avcrc charged to his account. The set off was charged for commission on goods sold. Judgment for the defendant. Johnston and Simpson, assignees of J. M‘Gaw v. E. J. Saunders— Ll7 19s Cd. Judgipcnt by consent for the plaintiff. Several cases Averc called, and dismissed for non-appearance,
