RESIDENT MAGISTRATE’S COURT.
This Day. (Before A. C. Strode, Esq., R. M.) Civil Cases. Walker v. damps Millar—A claim for balance of wages, amounting to L 5. Judgment by default for the plaintiff for the amount. Calcutt v. H. Hawker—A claim for L 3 Bs, for rent of paddock. Mr Harris for the defendant. An error having been made in the bill of particulars the case was adjourned for a week. . Hanslow and Sampson v. William Woods —L4 2. Judgment by default for plaintiff for the amount claimed. Pritchard v. Charles Rosa —L 8 10s, for horse shoes supplied. Judgment by default for plaintiff for the amount. Same v. Keogh—A claim for L 5 ss, for service by a horse. The defendant pleaded that the contract was not completed. Verdict for the defendant, Allen v. Young—Mr Barton for the defendant. A claim for damage through illegally impounding the plaintiff’s horse. The defendant denied the allegation. Ihe point in dispute was whether the fence was sufficient, and, if insufficient, whether it arose from any fault of the defendant. Accarding to the evidence for the defence the fence was sufficient, and had been broken down by the plaintiff’s horse. His Worship said he was of opinion that the word “substantial” did net mean substantial according to the provisions of the Fencing Ordinance. It appeared to him the fence was of a fairly substantial character, and that tlm horse was lawfully impounded. The plaintiff was not, therefore, entitled to recover.
