This Day. (Before A,O. Strode, Esq., R.M.) Pivn. Cases. Donelly v. Wood.—A claim of L 8 Os Bd, for wages, at the rate of IA a month, as cook on board the schooner Lismore, of which the defendant was master. From the evidence for the plaintiff, it appeared that after'being four days on board the Lismorc, the defendant told the plaintiff that as the bailiffs were on board the ship, he should have no further occasion for his services, and refused to pay his wages. He was said to be a competent cook. This was contradicted by the defendant, who said tjjat, as a cook, he was incompetent, and was not a seaman. Judgment for plaintiff for the amount claimed. Stamper v. Blandford.—Ll6 1 7b, for principal and interest of a promissory note. Mr Stewart for the plaintiff. Judgment by default for the plaintiff for the amount. S. Bird v, Baskett and George.—A claim for L 3 10s, for lime and cement supplied. Judgment for the amount claimed by default. Samuel Webb v. Same.—L9 lls 7d, for balance of account for goods supplied. Judgment by default for plaintiff for the amount, with costs. Law and Another, Trustees in the Estate of Key, v. Frederick Cross.—Ll9 4s. Mr Haggitt for the plaintiff; Mr Turton for the defendant. For the defence errors of account and a set-off were pleaded. The case was a very involved one, being an account current between Key and the defendant, who had acted as traveller on commission for Key Judgment for plaintiff, Ll4 13s 3d and costs.
