RESIDENT MAGISTRATE’S COURT.
This Day. (Before James Fulton, Esq., R.M.) JUDGMENT. Cairns v. Shand —His Worship gave judgment in this case as follows :—From the direct and positive evidence on behalf of the complainant, and which has in no way. been shaken by direct evidence for the defence, I can come to no other conclusion than that a stream of water found its way at all times across the road at or near the place in question on to the defendant’s land ; and that although the body of water may and probably lias been increased by the diversion of the Washpool Creek, still the defendant has in my opinion, by placing a dam across the course of the stream and thus flooding the road, contravcncddhe provisions of the Roads Ordinance, ISGS; and I must, therefore, inflict a penalty. Defendant fined 40s and costs.
