RESIDENT MAGISTRATE’S COURT.
This Day. (Before A. G, Strode, Esq., K.M.) Civil Cases. Macdonald v. M‘Donald.—A claim for L 67 ;Mr Stewart for the plaintiff. Verdict for the plaintiff by default. Radonski v. Davidson, master of the barque Cantero.- L2 ss, a claim for wages as able seaman on board the Cantero. The pla ntiff said that he shipped in Newcastle, and fell sick before arrival at Dunedin, and was 15 days in hospital. The captain offered as a balance of wages Bd. The plaintiff claimed the balance of a month’s wages. 511Hart, collector’s clerk, having charge of the Shipping Seamen Department, said the captain took the plaintiff to the Custom House for discharge on itrrrival, which he objected. to at the-tunc, on the ground that he might become chargeable to the Province ; but that since ' his recovery ' ill the hospital, the objection Was withdrawn, 1 The captain said that thoquayi was not fit ,to go to sea. Ho had engaged another man, and he had paid the hospital expenses, which were by agreement (o he deducted from by wages. H is Worship ruled that wages were- payable up to the time of the man’s discharge, subject to deduction of hospital expenoes. Verdict for the plaintiff, 16s 6d and costs. Provincial Treasurer v. Brotherston.—L27. The Provincial Solicitor said defendant admitted the debt and agreed to pay,by instalments. Judgment for the plaintiff for the amount. Brehncr v. Swaqi. -L33 Os 4d. Ward for the plaintiff;, defendant '(jaitßthat two pfunneids amounting to’ 1.12 I Os, wore not credited. On stating the amounts paid tlio (le'fcivlaut .admitted the correctness of the credits. Judgment fop plaintiff, L 33 Us 4d and costs. Petherick v. Cornwell.—A claim for balance of account amounting to L 136 6s 9d, .educed to LIUO to bring it within the jurisdiction <J' the C.uirt. -The claim was for work done u tier contract at tUe distillery, and for extra work, which .was charged at current rates of. "wages and «pst of material. Judgment for the plaintiff by default, LIOO. Scvcra,! cases were dismissed for nonappearance.
