RESIDENT MAGISTRATE’S COURT.
Tins Day. (Before James Fulton, Esq., R.M.) ASSAULT. Elizabeth Wilson charged B. Isaacs with this offence. Mr Wilson for defendant. It appeared that the latter had merely pushed the complainant in endeavoring to prevent her injuring another person with a bottle she had in her hand. Case dismissed, with costs. Sherwin v. Scott was also a charge of assault, and there was a cross-action of the same nature. In the first case defendant was lined 3t)s and costs, and the cross-action was dismissed. RE-HEARING. On the application of Mr Wilson, a rehearing of the case of Whitworth v. Currie for assault was granted, on the ground of the discovery of evidence which was not obtainable at the trial.
