SUPREME COURT.

This Day. CIVIL SITTINGS. (Before His Honor Mr Justice Ward.) YOUNG V. SMITH. This was an. action for slander, alleged to have been contained in certain statements made by the defendant to Mr I. N. Watt and other gentlemen. This case had been adjourned from the previous day. Mr Macasscy and air Haggitt appeared for the plaintiff, Mr W. Carr Young ; and MiBarton for the defendant, Mr James Smith. Mr Barton applied for a nonsuit on three grounds: —Erst, that there was no proof the words complained of were spoken of the plaintiff in his trade or business ; secondly, that supposing them to have been used, the words spoken were not slanderous ; and, lastly, that there was no proof of the exact words. His Honor refused the application. Mr Barton then addressed the jury at considerable length, after which the Court adjourned. The Court resumed at two o’clock. No witnesses were called for the defence. Mr Macassey having replied at considerable length, his Honor proceeded to deliver his charge, coming to a conclusion at a quarter past three. The jury then retired, and after a short deliberation, returned with a verdict for the plaintiff for LIOO.
