Defendant had lost a dog and charged the plaintiff with destroying it, at the same time asserting that he would take it out of his cattle. A short time after this, when the plaintiff’s cattle were brought in, the cow iu question was found to be seriously injured. The children in charge gave evidence of seeing defendant strike the cow with something, but could not state what it was.
