Djeab Sib,- —In reply to your inquiries respecting the road through sections 5 and 6, by which you approach your property from the main road, I beg to state the following circumstances which arc within my knowledge concerning it. The block road bounding sections 5 and G, block 6, on the record map of the town district, was found by the Government to be impracticable for the main south road, and an arrangement was made with the Church trustees, the awners of said sections, and Mr Macandrow, who was equitably entitled to a lease of the same, that the main road should be taken through the sections in a curved line as at present in use. About the same time, Mr Macandrow formed a road from the main road, as nearly as may be, along the boundary line between said sections 5 and G to his Carisbrook estate. Mr Macandrow sold his interest in the lease from the Church trustees to Mr J. S. Douglass, and the Carisbrook property to Mrs Anderson. Mr Douglass, by agreement with Mr Anderson, dated 10th April, 18G1, in consideration of fifty pounds, agreed to grant a right-of-way tlnough sections 5 and G, over the ro d so formed by Mr Macandrow, so soon as he should obtain a lca-:c from the church trustc >s. The church trustees consented to grant the lease to Mr Douglass, Mr T. B. Gillies acting for them in the matter, and Mr James Howorth for Mr Douglass. It was arranged, and agreed to by ail parties, that this road, as well as the main road, should become a public road ; and in order that they might be properly excepted out of the lease thou about to be granted to Mr Douglass, I had a survey made by'iVlr Mouutfort, whoso plan I have still in my possession, dated October, 18GI, and the lease was prepared in accordance with it, the roads being delineated on the plan in the margin, and excepted out of it : the intention being that the road through s motions 5 and G, as well as the main road, should always remain open for the use of the public, and, in my opiuon, they have, to all intents and purposes, been dedicated to the public.
