TREATMENT BY COURT

That the Court, when imposing a penalty for an offence, cannot take into consideration any oiher penalty that might or might not be imposed by any othar authority was emphasised in the Magistrate's Court yesterday by Mr. J. L. Stout, S.M., when fining Homer Oliver, labourer, £3 for assault. At the time of the assault, on October 6, Oliver had been 'a member of the Air Force and he had had his leave stopped as punishment, it was stated.

When members of the Army, Navy, or Air Force were brought before the Court, the Court had to inflict an adequate penalty, said the Magistrate. It could not take into consideration what other penalty might he imposed. Such defendants were brought before the Court under criminal law and had to be treated accordingly.
