FETROL AND HOLIDAYS
"I am surprised, on the facts disclosed in this case, that the man should be brought before the Court," said Mr. J. H. Luxford, S.M., in the Magistrate's Court today, when dismissing two charges, one of making a false statement to the Oil Fuel Controller, and one of improper use of oil fuel, brought against Leonard Bowley Bol-ton-Moss, a company director. It was revealed in evidence that the statement of the reasons for which the licence was required had included ";just observing statutory holidays," and also a description of districts in which the defendant expected to be making business calls.
"Is it not the duty of the issuing officer to see what he means when he wants the special licence for his 'statutory holidays'?" asked the Magistrate of an official of the Department who gave evidence.
The official said he thought it would mean that the licence would not be used for statutory holidays. Licences were not issued for holiday periods.
The Magistrate: Why not? It is not the practice, but there is no law against it.
