MISSING BAKER
PRESUMPTION OF DEATH
The appeal of the Australian Mutual Provident Society, the Colonial Mutual Life Assurance Society, £.td. t and the State, Fire Insurance Office", against a judgment of Mr. Justice Johnston granting an application by the Public Trustee to swear to the death of William Alfred Joseph Suiter Montgomery, a baker, of Ngatea, Thames, who disappeared on February 3, 1936, has been dismissed by the Court of Appeal. Montgomery was insured for about £3000 with the appellants.
The Court consisted of the Chief Justice (Sir Michael Myers), Mr. Justice Blair, Mr. Justice Kennedy, and Mr. Justice Northcroft. Mr. Justice Blair dissented, but the conclusion reached in the other judgments was that the disappearance was due to Montgomery's having succumbed to the only peril in the vicinity—drowning in the flooded waters of the Piako River.
Mr. G. G. G. Watson appeared for the appellants, and Mr. J. Byrne for the Public Trustee.
