POSITION AT GIBRALTAR
(Independent Cable' Service.) (Received January 2, 9.40 a.m.) LONDON, January 1. The Foreign Office states that the loyalist 'destroyer Jose Luis Diez will not.be interned, as no question of ibelligerency is involved. It is believed that she will be allowed to undergo repairs in Gibraltar harbour, as she did formerly.
BARCELONA, December 31,
A Barcelona communique states that the authorities in Gibraltar refused a request by the captain of the Jose Luis Diez for an extension of the vessel's stay to ensure its seaworthiness, so he went to sea to avoid internment. He alleges that he was attacked while in British territorial waters.
A communique issued by the rebels insists that only the minelayer Vulcano engaged/the Jose.' It does not rbention th'e'^loss *of a minelayer or the ramming ~df another.
