CASE DISMISSED
MANSLAUGHTER CHARGE
A charge of manslaughter preferred against Roy Patrick Frost, a fibrous plasterer, aged 27, was dismissed at the conclusion of the hearing before Mr. J. H. Luxford, S.M., in the Magistrate's Court yesterday, the Magistrate remarking that, even if the accused did strike the blow which it was alleged by the police caused the death of the deceased,, the whole situation was such, that no jury could reasonably convict on a charge of manslaughter or any other. "In my opinion," said Mr. Luxford,^ "there is not sufficient evidence to show that - the accused delivered a blow which resulted in Ryan's death.". The injury might- have been, caused when the deceased fell in a passage, or it might have been caused when .he fell out of bed during,.; the. night.x The evidence did not justify the information being sent forward.
The charge arose from the death of Francis Ryan, a storeman, who ; died at a boarding-house in Pipitea Street on December 23. ■ ;
After the, hearing: of evidence, Mr. E. Hardie Boys, for Frost, submitted that it was not a case that should be sent forward for trial. The accused was charged that by an unlawful act he cjiused the death of Ryan, but the evidence of one of the witnesses, Knowles, exonerated him.
