COMPENSATION CASE

HAWKES BAY EARTHQUAKE

Knal Icavo to appeal to the Privy Council was granted yesterday by the Court of Appeal in compensation cases arising out of the Hawkes Bay earthquake in February, 1931, which.were heard by the Court last year. There wero four cases:—Thomas Borthwick and Sons (Australaisia), Ltd., v. John Kyan; Nelsons (N.Z.)_, Ltd., v. John Prendergast; Thomas James Brennan and Charles Fenton Manning v. Philomena Mary Ashwell; and Thomas Borthwick and Sons (Australasia), Ltd., v. Margaret Brooker. The cases, which were typical cases ofinjury arising out of the earthquake, raised the following two questions: (1) Were the personal injuries suffered by four-men, leading in two cases to death, accidents within the meaning' of section 3 of the Workers' Compel sation Act, 1922; and (2) whether the injuries arose out of and in the course of the employment of the men.
