UNLAWFUL USE OF INSTRUMENT

ALLEGED.

The case against Elizabeth Ann Wyhe, alias Nevill (49), o£ having used an unlawful instrument on three women, was proceeded with in the Magistrates Court yesterday afternoon.. The Court was cleared. Mr.' E.. Page, S.M., was on the Bench; Mr. P. S. K. Macassey. conducted the prosecution and Mr. J. F, B. Stevenson acted for the accused. Three young women —Muriel Herhhy, Norah Cockram, and Ella Sylvia < Rushgave evidence of illegal operations performed upon them by the accused at her home, 150, Queen's Drive, Lyall Bay. Mr. Stevenson (to Cockram): "Have you received any promise from the police or the Crown that they would not get you into trouble?"—" No." Witness- said that she was giving evidence entirely of her own free will, although she had asked Mrs. Nevill to get her out of her trouble. She had thought that abortion was a legitimate thing, and had not known that it was a crime or that she was liable to criminal proceedings. After further evidence, Mr. Macassey said that four additional witnesses were to be called for the prosecution. He asked that the case be adjourned to Tuesday at 10.30 a.m. The application was granted, the accused being released on bail in the sum of £300, with two sureties of £150 each.
