Tuesday, August 7th, 1883. . (Before Major Keddell, R.M.) j T. H. Dunn v. The Vincent County Council. —This was a suit for an alleeeil bleach of the 138'h clause of the Counties Act, 1886, in so far as refusing to show the informant a certain book which he alleged to be the < original cash book of the County. M r F. J. Wilson appeared for the defence. Mr Dunn conducted his own case, and said : 1 was brought up as an architect and civil eng heeer. I know the original cash ■ bo"k of the County [t contains information I require. On the 19th June I posted a notice to the defendant th it I wanted a sight of the book. On the 28 r .h of .June I went to the office of the Vincent County, and asked the Clerk to allow me to look at the “ original cash book ” of the County that had b' en kept since the starting of the County. He produced a hook which I said was not the one I required, and wiuld not produce the one I wanted. As a ratepayer 1 went to the office an 4 donundei it as' a right. I told him T had every reason to bed ve it was in the office, if it hat not gone up the chimney. I i e isve I to d him that Iknew it eas in the office in December, 1882, or January, 1883. By Mr Wilson ; I have no witnesses. Mr Wi’am said he would apply for a nonsuit on one of the many grounds he hj id to go upon, viz., that while the info-mvit suss pects the existence of the hook ha refers to. he is nnahle to prove its existence. Hence his complaint is still a suspicion only. His Worship, after reviewing the evinsnce. dismissed the information with the customary profe-sional costs.
