Monday, June 3, 1883. (Before Major E»ddell. Esq., R.M., and W. G. Rees, Esq., J.P.) BREACH OF GAMING AND LOTTEIIES Act. Ah Chat, Ah Kow, Ah Dow, were charged with a breach of the Gaining and Lotteries Act, at Alexannra, on the night of Saturday the 2nd inst. Wong Gny noted as interpreter for the prosecution. Mr F, J, Wilson defended the accused, and pleaded not guilty. Constable Daly, stationed at Alexandra South, deposed tnat he knew the store kept i y Chong Hoy in Tarbart street, Alexandra. He was at the store on the 2nd inst., and saw one of the accused, Ah Kow, acting as banker in a game which he took to be Fan Tan. He could not recognise the other two. Cross-examined : The house was opened on the 2nd inst. Constable Nestor deposed that he was a constable stationed at Clyde, and proceeded to the new store opened by Chong Hoy on the 2nd inst. He was there at 2 p.m.. 8 p.m., and midnight. He saw the accused in a back room of the premises, Ah Kow had a stick (produced) in his possession, and was acting as banker in the game of Fan Tan He knew the game of fan tan. Ah Kow was at one -end of the table. Witness saw Ah Chat collect some money off the plate and saw him pay Ah Dow 2s. He then interfered and took possession of all ihe instruments connected with the gam» (produced) and 3ls. Witness then de-' scnb) I the game of fan tan. Wong Gye deposed that he was a district con-table stationed at Clyde, and proceeded to the store on the 2nn inst. at midnight. He went into the back room where they were playing. A number of persons were there, between 30 and 40. He saw the accused there. Ah Kow was acting as banker and handed money to Ah Chat, who paid 2s over to Ah Dow on the opposite side of the table. All the others were looking on. Constable Nestor was present at the time, also Constable Daly. This closed the case for the prosecution, and at the request of Mr Wilson, the necision of the Bench was deferred until after the hearing of the charge against the proprietor Chong Hoy was then charged with being the proprietor of a house in Tarbart street, Alexandra, where the game of fan tan was being played, ami through his solicitor, pleaoed not guilty. The evidence in this case was similar to that given in the p evious case, and after a due consideration of tUe circumstances surrounding the case, t e house having only been openeil that day, the Bench indicted a tine of £4, and £ I 7s costs. Ah Chat, Ah Kow, Ah Dow were then lined 20s each amt costs.
