Mr Wilson appeared for Applicant, and urged that under the existing laws it was compulsory for a man to build his house first, and then apply for a license, and the house being built, and the man satisfied to take out a license was evidence in itself that the house was required ; while admitting there was no large population in the immediate neighborhood, said, there was every day turning up fresh proof, by all the available laud in tho neighborhood being taken up, that the population was increasing, and further there was a strong probability of a large population consequent on the prosecution of the Strath Taieri Railway—he strongly urged that the license should be granted as a convenience to the travelling public.

Mr Fcraud for the Applicant gave evidence in favor of the license being granted as the house at Chatto Creek was not properly conducted.
