J> YE-L AW. NO. 3Regulating the Granting of Licenses to Peelers and Hawkers. 1. —Pedlers and Hawkers to be Licensed. From and after the commencement and coming into operation of this Bye-law it shall not be lawful for any person to carry on the business of a Pedler or Hawker in any place whatsoever within the Vincent County without having previously obtained a License as hereinafter directed; and if any person shall, without having first obtained such License, carry on such business within any part of the said’County he shall on conviction be liable to a penalty not exceeding five pounds for every such offence. 2. — Burden of Proof of being Licensed. Every person carrying on such business as aforesaid shall be deemed and taken to be unlicensed unless he shall prove the contrary by the production of his License or otherwise. 3. —Form of Licenses. Pedler’s Licenses shall be in the form of the First Schedule hereto authorising the holder thereof to carry on his own person his wares and merchandise for the purpose of sale ; and a Hawker’s License shall be in the form of the Third Schedule her-eto authorising the holder thereof to carry his witres and merchandise for the purpose of sale by pack-horse or other animal, or by cart ,or other vehicle, or by a boat, vessel, or craft; and such licenses shall be signed by the Chairman for the time being of the Vincent County Council. 4 . to be made to the County Clerk. Every person desirous of obtaining a Pedler’s ,or Hawker’s License shall deliver to the County Clerk a notice in writing applying tor the same; which notice if the application be for a Pedler’s License shall be in the form in the Second Schedule hereto, and’ if the application be for a Hawker's License such notice shall be in the form in the Fourth Schedule hereto. 5. —Applicant for License to lodge Certificate of Good Character. With the notice of application there shall be delivered to the County Clerk a certificate of the good character of the applicant signed by at least three householders resident in the County, or in some Boiough within the County, or in both. 6. —Fees payable for Licenses. Every person applying for a Pedler’s or Hawker’s License in the Vincent County between the months of March and October in any year shall before the same is granted pay to the County Treasurer the fees following, that is to say— For a Pedler’s License, LI. For a Hawker’s License, L 5. In the case of applications made after the thirtieth day of September one half only of the above fees shall be charged. 7. —Period of License. Every License granted under the provisions of this Bye-law shall be and continue in force from and after the date of the granting thereof until the thirty-first day of March then next ensuing, and no longer. 8. —Licenses to he Numbered. Each License shall be numbered in succession as Issued, and shall be registered according to its number. 9. —Number of License to be exhibited. Every licensed Pedler and Hawker shall at all times when peddling or hawking in ttie Vincent County, carry and exhibit on the pack, box, case, vehicle, boat, vessel, or craft wherein or whereon he carries his wares or merchandise a label or plate whereon shall be legibly painted, printed or inscribed the words “ Vincent County, Licensed Pedler {or Hawker as the case may he)" together with the registered number of his license ; and if any Pedler or Hawker shall fail or neglect to comply with this provision he shall on conviction be liable to a penalty not exceeding twenty shillings. 10. —Refusal to produce Lice'iise. If any such Pedler or Hawker having obtained such License as aforesaid shall, at any lime, on demand thereof being made of him by any Justice of the Peace, or Constable, or Officer of the County Council, or by any person to whom he shall within twenty-four hours previously have sold, or offered to sell any goods, neglect or refuse to produce and show to such Justice of the Peace or Constable or Officer of the County Council or other person his said License, he shall on conviction be liable to a penalty not exceeding five pounds for every such offence. 11. —Hiring or lending License. If any person shall let out, or hire, or lend any License granted as aforesaid, or shall trade with, or under colour of any License in which his own name shall not have been inserted as the name of the person to whom the same has been granted, the person so letting out, hiring, or lending any such License, and the person so trading with, or under colour of any such License shall, each of them, on conviction be liable to a penalty of five pounds ; and the License of any person who shall bo convicted of so letting out, lending, or hiring his License to any other person contrary to this Byelaw, shall be from thenceforth forfeited and void. 12. r Definition oj Pedlers and Haulers, Any person selling, or offering for sale within the Vincent County, goods carried about on the person, or on any animal, or on any moveable conveyance, whether by land or water, or offering for sale goods afterwards to be delivered, to persons not in the trade (other than those of his own manufacture or production) shall be deemed to be carrying on the business of a Pedler or Hawker within the meaning of this Bye law. 13. —Recovery of Penalties. All fines and penalties incurred under the provisions hereof shall be recoverable iri a summary way, and in the manner provided by “ The Justices of the Peace, Act, 1866," and any Acts amending the same. 14. ■lnterpretation Clause. In the construction of this Bye-law unless there be something in the context repugnant thereto, any word denoting the singular number, or the male sex, shall betaken to extend to any other number of persons and thibgs, and to both sexes. FIRST SCHEDULE. Form of a License for a Pedler. Vincent County, ) New Zealand, to wit, j Whereas of in the Provincial District of New Zealand, has applied to the Vincent County Council, for a Pedler’s License authorising and empowering him to carry on bis own person goods waiesand merchandise for the purpose of sale travelling on foot only without any horse or other animal bearing or drawing burden within the Vincent County : And Whereas the said Council have granted the Said application and the said hath paid to the County Treasurer the sum of shillings as the fee for such License: Now know ye that the said is hereby licensed to trade as such Pedler as aforesaid within the Vincent County and this License shall continue in force until the 31st day of March 18 and no longer.
