ALEXANDRA BOROUGH COUNCIL.
The ordinary meeting of the Council was held on Wednesday evening the 9th instant. Present—the Mayor and Councillors Theyers and Cameron. The minutes of the last meeting were read and confirmed. The outward correspondence was read and approved. The inward correspondence, consisting of letters from Vincent Pyke. Esq., and F. J. Wilson, Esq., referring to proposed Municipal Bye Laws were received. Moved by Councillor Cameron, seconded by Councillor Theyers,—That the consideration of Messrs Pyke and Wilson’s letters be deferred until the next meeting of the Council. Carried. Resolved on tho motion of Councillor Theyers, seconded by Councillor Camoron, —That the Town Clerk be instructed to procure a map of the land thrown open in the Tiger Hill district, in time for the next meeting of the Council. The following accounts were passed for paymentF. J. Wilson, L 4 4s Od ; W. Fawcatt, LI 11s 6d ; P. Brennan, L 3 Ss Od; and incidental expenses, L 1 4s Od. Councillor Theyers asked the Mayor if ho could give any information as to the quantity of gold forwarded by escort. Tho Mayor, in reply, stated that he could not say positively, but ho believed that tho last two Escorts wore each between six and seven hundred ounces. The usual vote of thanks to the Chair terminated the proceedings.

RESIDENT MAGISTRATE’S COURT. CLYDE, j —O—‘gfcjs Thursday, January 17, 1878. (Before W. L. Simpson, Esq., R.M.) A. T. Thomson v. Felton. Settled out of Court. Same v. Hastedt. Adjourned to February 28. Evidence of plaintiff in the mean time to ho taken in Dunedin. in this case was transmitted to plaintiff before receipt of the summons by defendant. Same v. Chappie. Amount paid into • QOttrt. * Attfield and Welsford v. C. T. Maine, Claim for illegal impounding. R. Holden v. name. I), Hanlon v. same. C. Holden v. same. J. Holt v. same. In the whole of the eases the evidence was identical, the defendant admitting having impounded the cattle from out of his garden and paddock. For the defence it was averred that the fence surrounding the paddock deposed to be trespassed in was not in accordance with the fencing ordinance, it averaging only from one foot six inches to three feet in height. The defendant said the fence was a good one, but not having had it measured was unable to apeak definitely. The cases, by consent, were adjourned till Thursday next the 24th instant. WARDEN’S COURT. Feraud v. Corporation of Clyde. Application for the Cancellation of a Water-race Certificate, and the abandonment of the Water-race on the ground of non-usage. This case was adjourned from the last Court; Day for the production of the Certificate of the Water-race and other papers. The Certificates were now handed in, also, tenders for the use of the said race. The case for the Plaintiff having closed. Mr F. J. Wilson, who was conducting the case for the Corporation rose and said—That the Application must be dismissed for the following reasons Ist—That the Plaintiff, being a Councillor, cannot bring the action. 2nd.—That the Plaintiff does not shew that he, as a riparian right-holder has ever tried to get the two heads of water to flow down the creek. 3rd—That there is abundant evidence to prove there was no abandonment as evidenced by the tenders. 4th.- - That the Municipal Corporation’s Water - Worka’Act, 1872 having been brought into operation in Clyde by the New Zealand Gazette and by proclamation, and there being evidence that the race in dispute was originally purchased as a part of the Water Works’ Scheme. Mr Feraud said there was I nothing to answer ; with respect, however, to the first pleading, ha distinctly stated that ho was not now a Councillor, but that he onlv became aware of that fact a few I days before bringing the present action ; ho i explained that ho was elected Councillor on j the-31st day of July, 1877 instead of the \ Ist August, and further that his declara- | tion was dated on July the 4th, whereas it j should have been some other day. i The Warden said the plea he had to couj sider most was the first one, and he would ; take time to consider it. Judgment was ; therefore reserved)
