Monday, June 4th, 1877. (Before His Honor George William 'Harvey, Judge.) J. Lanny v. J. Halley. Claim, L 172, money lent. Mr F. J. Wilson appeared for the Plaintiff. Defendant conducted his own case, who pleaded not indebted, "and handed in a set off for L2OB. Mr Wilson raised several technical objections to the set off. His Honor said the objections were fatal, and he'could not admit lit. Evidence of Plaintiff was then taken, which went to show that he had lent Defendant the money in four different sums during 1871, and that he had had no satisfaction for the same. Defendant admitted borrowing the money, but said it was accounted for in the set off. ST His Honor said he could not allow the items in the set off to be discussed, but as the Defendant had not the assistance' of a professional man to frame JtheTset off, he would adjourn the case till next 'sitting of the Court to enable Defendaut’fto amend the same. Costs of adjournment tojie costs of the cause. Frederick Jeffery through Mr F. J. Wilson, applied to have his naine'struck off the list of Contributories of the Otago Pneumatic Gold Mining Company, Limited, on the ground that since he took up the shares he had ■executed a Deed in favor of his Creditors. In reply to his Honor, Mr Wilson said the debt was not provable under the Bankruptcy, the Liquidation Order against the Company not being then granted. Applicant did not at the time of his Bankruptcy apply to have his shares' transferred to the Company, in colonial parlance he had let them slide. His Honor—The application is dismissed, the debt not having bean provable under the Bankruptcy. George M. Starkey, through Mr F. J. Wilson, marie a similar application, the ground of the application being various the principle one that, ho had successfully contested an action for Calls heard in the Resident Magistrate’s Court, Dunedin. His Honor—The application is dismissed. Applicant should have, but did not, applied to have had his name erased from the Share Register, when he gained the action against him for Calls. IN BANKRUPTCY. Re Samuel Simmonds, of Bald Hill Flat. —Application for final discharge.—Mr F. J. Wilson for Bankrupt. Granted,
