The Warden in giving Judgment, referledto the nature of the evidence given ; be said the Pla n‘iff had clearly c-stahlisn-ed iris right as co-owner, and had proved that quantities of gold had been obtained, hut failed to prove exact quantities, and to what he was entitled. Judgment for plni rtiff, Defendants to pay costs of action. The share to he sold hy auction.
