Monday, November 10. (Before W. Gray, Esq , Judge of District Court ) Muir v. Perriain.—Claim for £7O, value of three horses wrongfully detained by defendant. Mr. W. L. Bailey, who appeared for the defence* applied for an adjournment till the next sitting of tire Court alleging that a witness of great importance to his case had- gone to Dunedin. An affidavit to that effect having been put in, his Honor allowed the adjournment upon Defendant agreeing to pay costs of Court. COURT OF APPEALTuesday, November 17, Minton, Flannery an ’ Gavan, appellants, Goodwin, Williamson and Dick, respondents Mr. J. C. Chappie for appellants. The case had reference to a disputed priority of a water-right, and was he’d over for judgment at the sitting of the Court in September last. His Honor gave judgment for appellants, subject to a case stated, reserving a point of law for the Supreme Court
