RESIDENT MAGISTRATE’S COURT, CLYDE.
Tuesday, 19th November. (Before H. W. Robinson, Esq., R.M. ;J. D. Feraud, Esq,, J. P. ; and Wilson Grey, Esq., J.P.) Ejectment. —Brown v. 0, Connell, for illegally occupying a house situate at Rocky Point, his property. Mr. J. Chappel for defendant. From the evidence, it appeared, that under a Warrant of Distress, and by order of the Bailiff, Messrs Cope and Fache sold by Auction to the plaintiff on the ICth Oct. the right title and interest, (if any) of one .Tames Doran, to a building situate atßoeky Point, then in the occupation of the defendant, the plaintiff gave defendant notice to leave, such notice not being complied with, hence ihe present suit. In defence, a Bill of Sale of the property from James Doran for the sum of £34 was nroduced and handed to the Court’. The Bench, after deliberation, dismissed the case ; stating their judgment rested on the fifth clause of the Summary Ejectment Act, winch says,— “That whenever any defendant shall, on the hearing of the case, shew to the Court a prima facie right or- title in himself to such oecupa'ion, then the complaint shall be dismissed.” Police v. Cox.—For allowing cattle to wander within the boundaries of the Town as against the “Town and Country Police Ordenance.”—Fined ten shillings and costs.
