Parker v. the Awatero Road Board, to recover a balance due upon a contract, the plaintiff was non-suited on the ground that the contract provided that the final payment'should not be made till the inspector of works had given his certificate, which he refused to do, and that there was no evidence to show that the refusal was due to fraud or collusion with tho defendants.
