KLINBERG’S SENTENCE
Probation And Restitution Sydney Klinberg, managing director of Tiny Tots Manufacturing Company, who had been found guilty by a jury of having, about June 10, 1941, stolen 4300 yards of georgette and 5000 yards of kabe crepe, total value £1179/5/10, . the goods of Woolworths (N.Z.), Limited, was admitted to probation for five years by Mr. Justice Blair in the Supreme Court, Wellington, yesterday. His Honour said he had given a lot ot thought to the ease. From his point of view, the gravity of a case did not depend on the amount involved. As far as this fraud was concerned, the magni- ’ tude pf the amount, £1179, was not altogether the deciding factor. “You have hitherto- borne an absolutely blameless character,” said his Honour, addressing prisoner. “It looks as if you were subjected to temptation from a very clever rogue. Nevertheless, you were one of the thieves, as every person who takes part in a fraud is equally guilty. There can be no question of probation except on the basis of full restitution of the amount you are charged with having stolen. You will be admitted to probation for five years on the usual conditions, and on the special conditions that you repay the costs of the prosecution, £B/16/-, together with, the value of the stolen chattels, £1179/5/10, in monthly instalments of £25, payable on the first of each and every month, the first instalment to be paid on or before December 1 next.
"I give you a chance. You are a man of very great capabalities, ami I hope that you will respond to the chance I, am giving you, and show that my faith in you has not been misplaced.” Mr. AV. J. Stacey appeared for prisoner, and the Crown was represented l>.v Mr. AV. H. Cunningham.
