ALLEGED DANGEROUS DRIVING

EVANS BAY ROAD MISHAP A charge of having driven his motorlorry in a dangerous manner along the Evans Bay Road on a recent afternoon was denied by George Gillies, who appeared betore Mr. J. H. Salmon, SAI., in the Magistrate's Court vesterdav. R. E. Akers stated that while sitting on a seat on the Evans Bay Beach at about 4 p.m. on the day in question he saw a motor-lorry coming around the bend of the road from the direction of the city. Suddenly the vehjcle left the road, and, careering over a bank, made towards the witness, who was with his wife and children. He hardly had time to pull his family out of the way before the lorry had smashed the seat on which he had been sitting. _ One of his children suffered slight injury, while the other members of his family suffered from shock. In the opinion of witness, the defendant, who was the driver of the lorry, was intoxicated. Mr. W. E. Leicester, who represented defendant, said that Akers had no richt to make that suggestion, as the police had put defendant through the “test” and found him sober. The Magistrate, however, said he thought that witness was entitled to irive his own opinion. Witness, continuing, said a woman was in the lorry with the defendant, and she was trying to get rid of a paper parcel containing bottles of beer. Another eye-witness said that in his opinion defendant was not intoxicated, but he was drank, and that the woman ■with him was drunk also. His general behaviour was that of a drunken man.
