DECLARATION OF LEGITIMACY

INTERESTING ENGLISH CASE London, February 22. An interesting application under the Legitimacy Act, 1926, was heard by Mr. Justice Hill, who granted a declaration of legitimacy to Ladies Burnham and Somerleyton, Mrs. McCalmont, and Maximilian John de Bathe, all children of Sir Henry and Lady Charlotte de Bathe, who lived together for thirteen years before their marriage in 1870 owing to objections by Sir Henry’s father to the marriage. The four children mentioned above were born before the marriage, which took place following tire death of the objecting parent. It was pointed out that the declaration did not affect the de Bathe title, the Act specially stipulating that nothing therein could transmit the right of succession.

The present holder, Sir Hugo de Bathe, who married an actress, Mrs. Langtry, was the younger son of the same union, and was born after the marriage.
