In the Supreme Court, before Mr. Justice Herdman and a special jury, a case is being heard in which brederick Freeman Rogers, a farmer, of le Avvamutu is suing the Matarawa Land Company Ltd for £lOOO damages tor aliened misrepresentation of the sale ot a farm at Tpkoroa, near Putaruru. Over forty witnesses are being called, anil the case is likelv to last until Friday. It is alleged in the statement of claim that in 1920 defendant company, being fully aware that the land was cattle sick and unsuitable for dairying, subdivided the land and offered it at auction for dairving. Two farms were sold at fhe sale, but after endeavouring to milk on their lands for two seasons both farmers had to abandon their holdings on account of their heavy losses of stock through sickness. Four separate claims were set down for hearing against the company this session, but three could not be reached.
