LOTTERY ESTABLISHED

THROWING AWAY OF FOOTWEAR. Written judgment was given by Mr. E Pa"C SM. in the Magistrate s Court yesterday in the case in which Brady and Co. were charged by the police with establishing a lottery, and also with impeding the traffic and causing an obstruction in Willis Street Defendants caused an advertisement to be inserted in the local Press stating that they would throw into the street outside their shop footwear for the right toot, which would be mated on demand. So far as the members of the public who had gathered there wore concerned, said Mr. Page, the obtaining of eneli prize was a matter decided entirely bj chance. After quoting authorities, Mr. Page said he had been unable to find anj’ case in which a charge of conducting a lottery had been dismissed on the ground that the distribution was a gratuitous one. "Thp whole nndeitaking,” he said, "is obviously devised for the purpose of advertising. It was contemplated that the cost involved will be eventual! v recouped by the increased returns from defendants* business. The defendants would he convicted. On the second charge Mr. Page held that the by-law had been infringed, and convicted defendants. He did not: regard the breaches of the law as very serious ones, and fined defendants i‘2 and costs on each charge.
