DEPRECIATION FOR ODOURS
COURT AWARDS COMPENSATION. Dominion Special. Auckland, December 3. After having occupied the attention of the Court for two full days, claims for compensation amounting to £5392 brought by eight ratepayers of Sulphur Bay, Northcote, against the Borough Council for alleged depreciation caused to their properties bv odours from a septic tank was concluded this morning when the Court awarded a total of £22115 to seven "f the claimants.. The Court, in its judgment, said it seems clear that so long as manholes over the tank are kept sealed no nuisance is created, aud there is nothing to complain of in the wav of offensive smells, ft has been proved to our satisfaction that when manholes are lifted, either to clear blockage of inlet pipes or to hose away material that is continually formed in liquifying tanks, and especially when the latter operation is in progress, an offensive smell must arise which is apt to be a substantial nuisance to dwellers in the vicinity. Without going into the question as to how the amounts have been arrived at. we pres ceed to state a lump sum. The Court awards in each case are as follows, the amounts claimed beinr given in narenthesesGilmore. £550 (£1892); Brown, £5OO (£1150); Coleman £4OO (£600); Milliner, £330 (£425): Holland. £2OO (£425); Lepper, £175 (£300), Jamieson, £5O (£200); Corbett, nothing (£400). \
