TIMBER YARD ACCIDENT
WORKMAN AWARDED DAMAGES Reserved judgment was delivered by His Honour the Chief Justice in the Supreme Court yesterday in the case in which £lBOO was claimed by Patrick Brick from the Stewart Timber and Hardware Company, Limited. This sum was claimed as compensation for injuries received as the result of an accident on June 17, 1925, when the breaking of a sling caused the plaintiff’s leg to be broken by falling Negligence on the part of the defendants had been established at a previous hearing of the case before His Honour Mr. Justice Reed. The question of damages was not then settled, however, and His Honour the Chief Justice was asked on Thursday last to adjudicate on this question. After medical evidence had been called by Mr. O C. Mazengarb, for the plaintiff, and on behalf of the defendant by Mr. H. F. O’Leary. His Honour reserved his judgment, which was delivered yesterday. After giving credit for the amount paid to the plaintiff as compensation under the Workers’ Compensation Act, His Honour awarded the plaintiff, damages to the amount of £550 Is. 6d., with costs according to scale.
