AN HOTEL LEASE
CLAIM TOR COMMISSION FAILS. Mr. E. Page, S.M., yesterday heard the civil case of Fergus O'Sullivan and Co., land agents (Mr. C. A. L. Treadwell), against W. Baggstrom, of Taita, hotelkeeper (Mr. T. Neave). The plaintiffs sought to recover from the defendant .£lOO as commission for obtaining, as agent, on or about November 5, 1920, the sale of the lease of the Taita Hotel from the defendant to one Humphrey Allen, and which commission the defendant had refused to pay. The defence was that the contract of sale was subject to finance being arranged for the purchaser, and subject to the purchaser being able to obtain a license. Neither of these conditions had bce>n fulfilled, consequently the agent had not made an enforceable contract on behalf of the vendor, and therefore no commission was payable. ■After hearing argument, the Magistrate nonsuited the plaintiffs, and awarded the defendant costs totalling XS.
