ALLEGED THEFT OF DEFENCE STORES
RELEASE OF THREE MEN
The three young members of the Permanent Force, Charles Somerville Lennox, Alfred George Smith, and Walter Leslie Young, who were charged with the theft of tobacco and cigarettes from tho Defence Department, have been released, the Crown having entered a nolle prosequi.
After a disagreement of the jury on the occasion of the first trial, a re-trial was held, but in this case also tho jury disagreed. When the jury returned, Mr. Perry, for the accused, asked that the prisoners be released tinder section 18 of the Probation Act. His Honour Mr. Justice Hosking, in giving his decision yesterday morning, said that he would not comply with Mr. Perry’s request, but would not order a new trial. “You are not acquitted of the charge against you,” said the Judge, as the prisoners were released from custody. "Tho proceedings are merely being stayed under nolle prosequi.”
