LITIGATION IN MAGISTRATE’S COURT.

Litigation over tho price of a compressor came before Mr. F. K. Hunt, S.M., in the Magistrate's Court yesterday, when Kempthorne, Prosser, and Co., Ltd. (Mr. Buddle), sued J. S. Fairchild, dentist. Woodward Street (Mr. von Haast), for £l4, said to be. balance owing by defendant. The statement of claim alleged. that the compressor was quoted at .£39, sine tank, and Fairchild paid .£25. For the defence it was submitted that defendant had been told that £25 was the price of the tank, and that a definite “quote” to that effect had been made., Tho defendant said he had served during the war. While he was'.away, his outfit in New’ ’Zealand was burnt, and he, while in America, negotiated for new implements, which he obtained for 600 dollars, less 40 per cent. “Don’t forget that, sir,” he added. , “Forty per cent.?” replied Mr. Hunt. "I should think not.” Defendant gave instances of transactions he had had with the plaintiffs, and alleged that definite “quotes” for a certain appliance had been made to him, before the goods had arrived in New Zealand. This, was after November, 1917. He had decided to purchase the compressor after his motor had broken down. The price on a pamphlet Jiad been quoted as the retail price in i>ew Zealand. After hearing counsel’s address, His Worship reserved decision.
